What is Traffic School and Who Needs to Take it?

For most people, traffic school is a means of forgiveness after committing a minor traffic infraction, such as speeding. However, there are a few citations that require you to attend a traffic course or else you could lose your drivers license!

Completing a Basic Driver Improvement Course is mandatory if:

  • You were at fault in an accident in which someone went to the hospital
  • You were at fault in two crashes in a two year period in which the total property damage was more than $500
  • You passed a stopped school bus
  • You participated in (or were a spectator of) highway racing
  • You were cited for reckless driving
  • You ran a red light

If you receive a traffic citation for any of these offenses, the Department of Highway Safety and Motor Vehicles will send you a notice within 90 days of receiving the citation. This notice will indicate that you must complete a Basic Driver Improvement Course, also known as defensive driving course or traffic school.

Florida Eligibility Requirements for Online Traffic School

Traffic school is a great option for people that want to prevent points from being held against their license. Attending traffic school is also beneficial for drivers who would like to reduce their insurance rates or simply become more defensive on the roads. While traffic school is a readily available option for a vast variety of people, there are a few restrictions that you should be aware of.

In-person and online traffic school Florida eligibility requirements state that drivers with a commercial driver’s license (Class A, B or C licenses) cannot elect to attend traffic school in order to prevent points from a ticket. Similarly, you cannot attend a driving school if you are cited with a criminal violation, such as driving under the influence, leaving the scene of an accident with property damage or knowingly driving with a suspended license.

If you received a non-criminal moving violation (speeding, passing a stopped school bus, failing to yield at a stop sign, failing to wear your seat belt, parking improperly, etc.), then you are qualified to attend traffic school to avoid the point penalty. If you were the at-fault driver in a collision in which someone was taken to the hospital, or, if you had two collisions within two years where the property damage was over $500, then you also qualify to attend traffic school.

How Often is Traffic School an Option?

When people complete a driver improvement program, it is expected that they will learn how to become a more defensive driver, which will reduce their likelihood of being in accidents. For this reason, you are eligible to attend only once within a 12 month period of time. Florida mandates that you can choose to attend traffic school up to only 5 times in your lifetime. However, you may be eligible to attend more frequently if approved by a judge.

Taking Driving School to Prevent Points from a Traffic Ticket

If you recently received a ticket, the reality can be shocking. Not only is there a fine to pay, but there are also points that can add up that eventually result in revocation of your drivers license. Luckily, you have options. Did you know that you can prevent points from being assessed on your license by attending traffic school? As long as you are charged with a moving or non-moving, non-criminal traffic violation and do not hold a CDL (commercial drivers license), you are eligible to attend driving school to avoid point penalties and prevent insurance premium increases.

Driving school will allow you to:

  • Prevent points from the traffic violation from being assessed against your license
  • Prevent a premium increase on your insurance as a result of the traffic violation (unless it is the second infraction within 18 months, a third infraction within 36 months, or the driver exceeded the speed limit by more than 15 mph)

Electing to Attend

You should visit the clerk’s office in the county where you received your traffic citation to complete the affidavit. Sometimes, the officer may provide you with a citation envelope which allows you to read and complete the affidavit and mail it in. Either way, remember that the court must have the affidavit within 30 calendar days from when the ticket was issued. Unfortunately, electing to attend a driving school does not automatically allow you to waive the civil fine. However, you might be able to get a reduced fine for electing to take a driving course. Check with the county clerk’s office to determine the cost of the civil fine that accompanies the election to take a traffic class.

Driving School Completed: Now What?

Once you elect to attend a driving class, you will need to complete the course and present proof of completion to the county clerk. Although you must normally complete the course and present proof within 60 and 90 days of the original citation, you should make sure to contact the clerk’s office so that you meet the specific requirements.


Florida Driver Improvement Course

If you receive a ticket for a civil traffic violation, drivers can elect to attend a Florida driver improvement course, also known as BDI (basic driver improvement), TCAC (traffic collision avoidance course) or Red Light course. Upon completing traffic school, we will automatically file your completion status with the Florida Highway Safety and Motor Vehicles. Keep in mind that it can take 24-72 hours for your completion status to appear on driving history. However, if your license is already suspended, you can contact the FLHSMV and they will manually enter it so that your license can be reinstated.

Driver’s Responsibility

In order to meet the requirements set by the court, drivers must:

  • Present proof of completion within the specified time frame to the county that the ticket was issued

Plan Ahead

Make sure you have a plan to get your certificate in a timely manner. If you do not complete traffic school within the required time period, you could face additional fines. Additionally, in the event that you are required to complete traffic school in order to maintain your license, the court may initiate the license suspension process. Failure to resolve the process within the given time frame that is indicated on your citation will lead to any points from the traffic infraction being added against your license. This will also be reported to your insurance company and could lead to an insurance increase.


Take a Driver Improvement Course for an Insurance Discount
